1. Agreement
These Terms of Service and Student Agreement (Terms) form a binding agreement between you and Lift-Right Training Institute LLC (Lift Right, we, us, or our). By purchasing, enrolling, creating or using a student account, accessing course materials, or affirmatively accepting these Terms, you agree to them and to the Privacy Policy, Refund Policy, and Acceptable Use and Course License Policy.
If you do not agree, do not purchase, enroll, or access the services.
2. Eligibility and authority
You must be at least 18 years old to purchase or create an account. A student under 18 may participate only with prior written approval from Lift Right and the agreement of a parent or legal guardian. The services are not directed to children under 13.
If an employer purchases training, the employer represents that it is authorized to enroll the identified participants, and each participant must comply with these Terms.
3. Independent exam preparation
Lift Right is an independent education and exam-preparation provider. It is not affiliated with, sponsored by, approved by, endorsed by, accredited by, or an agent of the National Commission for the Certification of Crane Operators (NCCCO). Lift Right does not administer NCCCO or CCO examinations, issue NCCCO or CCO certifications, or award academic credit, a degree, diploma, professional license, or industry certification.
Courses are intended to help candidates prepare for applicable examinations. Enrollment and completion do not guarantee examination eligibility, a passing score, employment, promotion, qualification, licensing, or certification. Students are responsible for confirming current eligibility, application, identification, medical, experience, testing, and recertification requirements with the applicable certification organization.
4. Educational and safety limitation
Course content, practice questions, videos, slides, portal tools, instructor communications, and AI-generated responses are educational study aids. They are not engineering services, a site-specific lift plan, operational authorization, equipment approval, legal advice, or a substitute for competent supervision.
Before any real-world operation, users must independently verify safety-critical information using the current manufacturer manual and load chart for the exact equipment and configuration, applicable law and regulation, employer procedures, site conditions, approved lift plans, and qualified site supervision. If any course information conflicts with an authoritative source, the authoritative source controls.
5. Course access and entitlements
A single-course purchase grants access only to the purchased Core, LBC, or TLL course area. The Complete Bundle grants access to Core, LBC, and TLL. Portal permissions, downloads, practice exams, and progress tools are limited to the purchased course entitlement. Instructor-Guided Preparation is a distinct optional product delivered through Google Classroom, priced and purchased separately, and is not included with a course or bundle unless the order confirmation expressly states otherwise.
Course and portal access begins when Stripe confirms successful payment and ends on the corresponding calendar date six months later. If that date does not exist in the ending month, access ends on the final day of that month. Accounts and invitations are personal, limited, revocable, and nontransferable. Lift Right may correct an entitlement or suspend access issued in error.
6. Instructor-Guided Preparation
The Instructor-Guided Preparation add-on includes a personalized study plan, graded work, written feedback, two scheduled classroom meetings, and a final readiness review for the associated purchased course or bundle. Meeting dates are arranged by mutual availability.
Both classroom meetings and the final readiness review must be scheduled and completed during the applicable six-calendar-month course access period described above. Purchasing or using the add-on does not restart or extend course access. Missed, unused, or unscheduled meetings do not automatically extend access. A readiness review is an educational judgment and does not determine examination eligibility, guarantee a passing score, or issue a certification.
7. Payments, taxes, and third-party processors
Prices are stated in U.S. dollars unless indicated otherwise. You authorize the payment processor to charge the displayed amount and applicable taxes. Payment-card information is handled by the payment processor, not stored directly by Lift Right except as the processor may make limited transaction information available.
External examination, application, scheduling, travel, equipment, and credentialing costs are not included unless expressly stated. Consulting services are governed by a separate written agreement or statement of work.
8. Refunds
Refund eligibility is governed by the Refund Policy in effect at the time of purchase. A chargeback does not replace the refund-request process. Lift Right may suspend access while a payment dispute or suspected unauthorized transaction is investigated.
9. Intellectual property
Lift Right course materials, original questions, videos, text, graphics, branding, software, and arrangement are owned by or licensed to Lift Right and protected by intellectual-property law. Enrollment provides a limited license for the enrolled student’s personal study only; it does not transfer ownership.
NCCCO, CCO, and related names and marks belong to their respective owner and are referenced solely to identify the examinations for which independent preparation is offered.
10. AI and automated tools
AI features may generate incomplete, outdated, or incorrect information. AI output must not be treated as an official answer key or operational instruction. Do not enter personal, medical, proprietary, export-controlled, employer-confidential, or safety-sensitive information into an AI feature. Lift Right may review interactions for safety, quality, misuse prevention, and course improvement as described in the Privacy Policy.
11. Availability and changes
Lift Right may update content, correct errors, change platform providers, perform maintenance, or replace substantially equivalent delivery methods. Temporary interruptions do not automatically create a right to a refund, but verified extended non-delivery is addressed in the Refund Policy.
12. Disclaimers and limitation of liability
To the fullest extent permitted by law, the services are provided on an as-is and as-available basis without warranties of a particular examination result, uninterrupted availability, or fitness for a specific operational purpose.
To the fullest extent permitted by law, Lift Right will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost wages, profits, opportunities, data, or certification; or injury or property damage arising from unauthorized operational reliance on educational content. Lift Right’s aggregate liability arising from a purchased course will not exceed the amount paid to Lift Right for the course giving rise to the claim. Nothing in these Terms excludes liability that cannot lawfully be excluded.
13. Governing law and disputes
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law rules. Before filing a claim, the parties will make a good-faith attempt to resolve the issue through written notice to john@liftright-training.com. Any unresolved proceeding must be brought in a court of competent jurisdiction in Virginia, except where applicable consumer law requires otherwise.
14. General terms
If a provision is unenforceable, the remaining provisions remain effective. Failure to enforce a provision is not a waiver. You may not assign your account or rights without written permission. These Terms and incorporated policies are the complete agreement for website and course use unless a separate signed agreement expressly controls.
Lift Right may update these Terms prospectively. Material changes will be posted with a revised effective date. Continued use after the effective date constitutes acceptance where permitted by law.
